SECTION 172 · REMINDER
I received a reminder but never saw the original Section 172 request
A reminder may be the first warning that an earlier request was sent. Whether and when the original was served can become important, but the immediate priority is to protect the current position rather than ignore the reminder.
Checked against primary legal sources for England and Wales · Updated 5 September 2026 · How we review content
Contact the issuing office promptly using the details on the reminder, request a complete copy and ask how an accurate response should now be made. Preserve the reminder, envelope, address history and post evidence. Obtain urgent advice if the original period is said to have expired.
Confirm what the reminder is asking you to do
Identify the document stage privately and build the immediate evidence checklist before contacting the issuing office.
Protect the deadline before deciding anything else
- Keep the reminder and envelope
- Record the date it actually arrived
- Check the address shown against the V5C and your address history
- Request a copy of the original and confirm the available response method
- Respond accurately as soon as possible and obtain advice about any disputed service issue
Gwent: reminders and court referrals are different measures
GoSafe reported 9,245 reminders and 2,585 Section 172 court referrals in the Gwent area in 2025. Camera detected seatbelt offences are excluded. The figures are not convictions, MS90 endorsements or linked recipient outcomes.
The disclosure describes no online response facility during 2023 to 2025. Check the instructions on your current notice rather than assuming that historical position still applies.
Will every force send a reminder?
No universal reminder practice can be assumed. West Yorkshire Police told NoticeReady that reminders are not sent in the camera enforcement process covered by its September 2026 disclosure. Dashcam offences were excluded.
If you have a request, work from that document and preserve proof of response. If a reminder does arrive, follow the instructions above and do not assume it creates a new statutory period.
What does the West Mercia evidence show?
West Mercia Police reported 3,664 court cases raised for failing to provide driver details in 2025. NoticeReady calculates that this was exactly double 2024 and 132.6 percent above 2023.
The force's reminder series moved sharply and fewer reminders than court cases were reported in 2025. The annual measures therefore cannot be treated as a matched funnel or used to calculate the chance that a reminder leads to court.
What does the Kent trend tell us?
Kent reported 2,483 failure to provide cases referred for summons in 2025, up 116.3% compared with 2023 on NoticeReady's calculation. Its separately reported reminder count fell over that period.
These are not matched case records. The contrast does not show that reminders caused or prevented referrals, and referrals are not convictions. Use the evidence to understand the different stages, not to estimate your own outcome.
Does a reminder restart the 28 day period?
Do not assume that it does. A reminder may allow further administrative time, but its effect depends on the documents and facts. Check the dates printed on both documents and obtain advice if the original period is disputed or expired.
What does the Greater Manchester evidence show?
Greater Manchester Police reported producing 40,436 reminder notices in 2025. It also recorded 11,811 alleged failure-to-provide cases under section 172(3) as referred, charged or otherwise proceeded with in that year.
Those operational figures do not predict the outcome of an individual case, and the 11,811 measure is not a conviction or MS90 endorsement count. They do show why a reminder should be treated as a consequential procedural document rather than ordinary correspondence.
What do the Norfolk and Suffolk figures show?
Norfolk and Suffolk Constabularies reported 30,787 NIP and Section 172 reminder letters in 2025. Suffolk's reminder count increased from 7,652 in 2023 to 17,431 in 2025, a rise of 127.8 percent.
The figures do not show that every reminder led to prosecution. The forces separately recorded 273 failure to furnish prosecutions in 2025, but did not provide a conviction or MS90 endorsement count.
How can post be treated as served?
Legislation can treat a properly addressed, prepaid and posted letter as served in the ordinary course of post unless the contrary is proved. Service disputes are evidence sensitive. Keep envelopes, address records, returned mail evidence and a clear chronology.
What if the notice went to an old address?
Obtain the V5C and check its document reference date and address. A driving licence address and a vehicle keeper address are separate records. Record any move, DVLA notification, postal redirection and the date each change was processed.
Should I wait for the copy before responding?
Do not create avoidable delay. Contact the issuing office immediately and ask how to respond accurately while the copy is supplied. Keep a record of the call, email or online message and every submission.
What if court papers have already arrived?
The matter has moved beyond an administrative reminder. Keep the charge and evidence bundle together, check the plea deadline and obtain legal advice before entering a plea.
Turn your paperwork into a clear next-step checklist.
Preserve the notice, dates and response record
Build a notice chronology, deadline record, document checklist and concise solicitor briefing in NoticeReady Case. It does not determine whether the notice is valid.
