MS90 conviction: code, six points, appeal and statutory declaration

MS90 is the DVLA endorsement code for failing to provide driver information. It carries six points. If you discovered the conviction through the DVLA, an insurer or an enforcement letter, obtain the court record and check the urgent statutory declaration or appeal route.

Short answer

Identify the convicting court, offence, conviction date and case number immediately. Record the exact date you first learned of the proceedings and obtain urgent legal advice. A statutory declaration or another court procedure may be available, but strict timing and the way the case began matter.

MS90 statutory declaration action check

Record when you first learned about the case and identify what must be obtained from the court. The ordinary 21 day reference point is an urgent organising marker, not a decision that a declaration is available or will be accepted.

Keep the document, screenshot or letter showing how and when you learned about the proceedings. Do not enter a case number, address or other personal information here.

Important: The correct procedure depends on how the case began and what you knew. Sections 14 and 16E of the Magistrates’ Courts Act 1980 contain different statutory declaration routes. A court may have power to accept a later declaration, but delay should never be assumed safe. Obtain urgent regulated advice before making a declaration or entering any plea.

Derbyshire: unavailable figures are not zero outcomes

Derbyshire says reminder and alleged failure to provide information figures are held but withheld on cost grounds. This does not establish a reminder policy, conviction count or MS90 total. Use the actual notice or court record to understand an individual case.

Gwent: reminders and court referrals are different measures

GoSafe reported 9,245 reminders and 2,585 Section 172 court referrals in the Gwent area in 2025. Camera detected seatbelt offences are excluded. The figures are not convictions, MS90 endorsements or linked recipient outcomes.

The disclosure describes no online response facility during 2023 to 2025. Check the instructions on your current notice rather than assuming that historical position still applies.

Does the West Yorkshire disclosure establish MS90 outcomes?

West Yorkshire Police says reminders are not sent within the camera enforcement scope of FOI 3144664/26. It withheld the requested failure to provide proceedings figures on cost grounds.

The response therefore establishes no conviction or MS90 count and no causal connection between reminder practice and convictions. An unfamiliar MS90 must be checked against the actual court and DVLA records.

What does the West Mercia evidence show?

West Mercia Police reported 3,664 court cases raised for failing to provide driver details in 2025, exactly double 2024 and 132.6 percent above 2023 on NoticeReady's calculation.

That is a court case measure, not a conviction or MS90 endorsement count. It shows the scale and growth of the procedural route without proving the outcome of any individual case.

Why a referral count is not an MS90 count

Kent reported 2,483 failure to provide cases referred for summons in 2025. That counts an earlier procedural stage, not convictions or MS90 endorsements. An MS90 question must be checked against the actual driving record and court record, not inferred from force statistics.

What does MS90 mean?

MS90 is the driving record endorsement code commonly associated with failing to give information about the identity of a driver. The underlying charge, the request allegedly served and the court record must still be obtained. Do not rely on the code alone.

What does the Greater Manchester evidence show?

Greater Manchester Police recorded 11,811 alleged section 172(3) cases as referred, charged or otherwise proceeded with in 2025, alongside 40,436 reminder notices.

That broad procedural count is not a count of convictions and not a count of MS90 endorsements. It nevertheless shows the scale at which a missed or disputed driver information request can move into consequential enforcement.

Why is the discovery date important?

The statutory declaration routes for proceedings a defendant did not know about ordinarily contain a 21 day period running from the date of discovery. A court may have power to accept a later declaration, but delay should never be assumed safe. Record the date precisely and act immediately.

How do I apply after discovering an MS90 conviction?

GOV.UK directs a person who did not know about the case to apply to the court, make a statutory declaration and attend a hearing. Start by identifying the convicting court and case reference. Keep evidence of the date you first learned about the proceedings, because the ordinary 21 day period runs from discovery rather than the conviction date.

Do not send an unofficial declaration without first checking the correct court route. The declaration addresses lack of knowledge of the proceedings; it does not by itself decide the underlying Section 172 or speeding allegation.

Does a statutory declaration delete the case?

A valid statutory declaration can make earlier proceedings void, but it does not necessarily end the allegation. The prosecution may continue from the appropriate stage. The effect, plea position and any associated speeding charge require advice.

How many points does an MS90 conviction carry?

The official endorsement code table records MS90 as failure to give information as to the identity of the driver and assigns six penalty points. The endorsement normally remains on the driving record for four years from the date of the offence.

Six points can trigger new driver revocation or contribute to a totting up risk. Obtain the complete driving record rather than relying on an insurer summary.

How can an MS90 conviction affect insurance?

Insurers decide whether and on what terms they will offer cover. Answer proposal and renewal questions accurately and check the wording used by the insurer.

A statutory declaration application should not be described as successful before the court has accepted it and the driving record has been updated.

What documents should I obtain?

  • DVLA driving record
  • Original NIP and Section 172 request
  • Proof and address used for service
  • Written charge or SJPN
  • Conviction and sentence record
  • Enforcement letters
  • V5C and address change evidence

Should I contact the insurer first?

Deal with the court position urgently and answer insurance questions truthfully. A declaration or reopening application should not be described as successful before the court has accepted it. Keep records of every notification and decision.

QUICK ANSWERS

Frequently asked questions

Can I make a statutory declaration online?

The available process depends on the court and the way proceedings began. Contact the convicting court and obtain advice rather than using an unofficial template.

What is MS90 on a driving licence?

MS90 is the endorsement code for failing to give information about the identity of a driver. The code carries six penalty points, but you should obtain the court record to identify the exact charge and proceedings.

Can a statutory declaration remove an MS90 conviction?

If the court accepts the correct declaration, the earlier proceedings may be treated as void and the driving record can be updated. The prosecution may still continue with the underlying allegation, so removal should not be assumed until the court and DVLA records confirm it.

Will the six points disappear immediately?

Do not assume that. The court must accept and process the appropriate procedure, and the prosecution may continue. Check the court and DVLA records afterwards.

How many points is an MS90 conviction?

MS90 carries six penalty points and normally remains on the driving record for four years from the date of the offence.

Does MS90 affect car insurance?

It can. Insurers may regard MS90 as significant, so answer questions accurately and disclose the endorsement where the policy wording requires it.

What if I found out more than 21 days ago?

Act immediately. The legislation permits a court to accept some declarations outside the ordinary period, but acceptance is not automatic and delay requires explanation.
