Do not ignore the paperwork. Preserve the original, identify every incorrect detail and separate any possible NIP issue from the Section 172 driver information requirement. A defect does not automatically remove the duty to respond accurately.
Protect the deadline before deciding anything else
- Keep every page and the envelope exactly as received
- Copy the alleged offence, date, time, location, vehicle and speed into a comparison list
- Check the V5C keeper details and any recent vehicle or address change
- Preserve journey records and original footage relevant to the alleged time and place
- Respond to any separate Section 172 requirement using its instructions and obtain advice before relying on the error
Which errors may matter?
The statutory notice ordinarily identifies the nature of the alleged offence and the time and place where it is alleged to have occurred. An error that creates real uncertainty about the incident is different from an obvious typographical mistake that causes no confusion. The complete notice and factual context require review.
What if the registration or vehicle is wrong?
Check whether the notice is genuinely about another vehicle, whether a registration character was misread or whether the displayed registration may have been copied. Preserve proof of where your vehicle was and contact the issuing office using the details on the notice. Do not accuse another person or publish registrations online.
What if the name or address is slightly wrong?
A misspelling or formatting error is not necessarily decisive. Check whether the notice was addressed and delivered to the intended recipient and whether the DVLA keeper record was correct at the relevant time.
What if the speed limit, signs or location look wrong?
Record the precise location and direction stated. Preserve original footage and take safe dated photographs of the full approach, every relevant sign and any roadworks. Do not edit the original files or rely only on a cropped image.
Why is the Section 172 part separate?
The notice of intended prosecution and a requirement to identify the driver perform different legal functions. A concern about the first does not safely justify ignoring the second. Respond accurately and retain proof while any alleged defect is investigated.
