Totting up ban: when 12 points can lead to disqualification

The number visible on a licence is not the whole calculation. The relevant offence dates, the period in which points were accumulated and earlier disqualifications all matter.

Short answer

A driver who accumulates 12 or more relevant penalty points within three years is ordinarily liable to disqualification. GOV.UK states the usual ban is six months, increasing for qualifying repeat disqualifications.

Which dates matter for the three-year calculation?

For totting-up, the dates of the offences are central. Points may remain displayed on a driving record for longer than the period during which they are valid for totting purposes. Obtain the full driving record and verify each offence date.

Is a six-month ban automatic in every case?

The statutory scheme sets the ordinary minimum period, with longer periods where there have been qualifying previous disqualifications. The court may reduce or avoid the normal period where exceptional hardship is properly established, but inconvenience alone is not the test and evidence is required.

What should I prepare?

Should I accept a fixed penalty if it takes me to 12 points?

Do not make that decision without understanding the effect on your licence. A fixed penalty may not be administratively available where endorsement would trigger the totting process, and the case may proceed to court.

What if six of the points are MS90?

MS90 carries six points, so a single endorsement can materially change the totting calculation. It can also create a separate insurance disclosure issue. Check the offence date for the three-year points calculation and the conviction date for the separate rehabilitation period.
