MOTORING FIXED PENALTY NOTICE

Motoring fixed penalty notice: accept it or go to court?

A police motoring fixed penalty notice can dispose of an allegation without prosecution if every condition is met on time. It is not the same document as a council Penalty Charge Notice for parking or traffic enforcement.

Checked against primary legal sources for England and Wales · Updated 14 August 2026 · How we review content

Short answer

Read the offence, payment, licence, points and deadline on the actual notice. Accepting a valid offer ordinarily concludes that allegation on its stated terms. Rejecting it, asking for a hearing or failing to comply can lead to prosecution, where the court decides guilt and sentence.

What is a motoring fixed penalty notice?

It is an offer to deal with an alleged fixed penalty offence without prosecution if the recipient complies with the statutory and notice conditions. Some motoring fixed penalties carry penalty points and some do not. The notice itself identifies the alleged offence, amount, response method and time limit.

For ordinary speeding, a common conditional offer is £100 and three points. Different offences and circumstances can produce different terms, so do not apply that figure to every motoring fixed penalty.

Is an FPN the same as a Penalty Charge Notice?

No. In common search results, FPN and PCN pages are often mixed together. A police motoring Fixed Penalty Notice can concern a criminal road traffic allegation and may carry licence points. A Penalty Charge Notice usually concerns civil parking or traffic enforcement and follows a different challenge process.

Use the full heading, issuer and offence wording on your document. Do not use a council parking appeal route for a police motoring fixed penalty.

What does accepting the fixed penalty mean?

If the offer is valid and every condition is met on time, the allegation is ordinarily concluded through the stated payment and any endorsement. Check the payment route, identifying information and licence requirements carefully and retain confirmation.

Acceptance is not the same as a court finding after a trial, but the penalty and points can still affect the driving record, insurance, new driver revocation and totting up position.

Can I challenge a motoring fixed penalty notice?

You can decline the offer or use the procedure stated for requesting a hearing, but that normally exposes the allegation to court determination. The fixed penalty is not a negotiation mechanism and sending an informal explanation may not pause its deadline.

Before choosing court, identify the actual defence, evidence and procedural issue rather than relying on a general sense that the notice is unfair. Compare that position with the known disposal and the court risks.

What changes if the allegation goes to court?

A not guilty plea leads to a contested case. If convicted, the court applies the relevant sentencing guideline and may order prosecution costs and a statutory surcharge in addition to sentence. A guilty plea may receive credit against sentence, but that does not guarantee the fixed penalty outcome.

The court may have wider powers than the fixed penalty, including a higher fine, different points or disqualification depending on the offence and facts.

What if I miss the fixed penalty deadline?

Do not assume that late payment will be accepted or that the allegation has disappeared. Check the notice and any later correspondence, contact the issuing office about procedure without making unsupported admissions, and obtain advice if court papers have arrived or the licence consequence is serious.

When should I obtain advice before deciding?

  • You dispute being the driver
  • The offence or evidence is disputed
  • The first NIP appears late
  • Accepting the points may reach 12
  • A new driver may reach six points
  • Special reasons or a possible defence may arise
  • The deadline is close or has passed

What if I was speeding during a medical or other emergency?

An emergency does not automatically cancel a motoring allegation. Depending on the precise facts and law, it may relate to a defence, a special reason or ordinary mitigation. Those are different legal routes with different consequences.

Preserve medical records, call logs, messages, timings, route information and evidence of why no reasonable alternative was available. Obtain regulated advice before rejecting a live fixed penalty whenever possible.

QUICK ANSWERS

Frequently asked questions

What happens if I pay a motoring fixed penalty notice?

If the offer is valid and every condition is met on time, the allegation is ordinarily concluded on the stated terms, including any penalty points. Keep payment and submission confirmation.

Can I appeal a fixed penalty notice?

A police motoring fixed penalty is generally accepted or the allegation is left for court determination under the procedure stated on the notice. It does not use the same appeal route as a council parking PCN.

Does asking the police a question pause the deadline?

Do not assume that it does. Use the printed deadline unless the issuing body expressly confirms a different period.

Is a fixed penalty notice a criminal conviction?

Payment avoids prosecution for the fixed penalty offence, but an endorsable motoring penalty can still place points on the driving record and create practical consequences.
